1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of GymHealth.AI, including our website at gymhealth.ai, mobile applications, and all related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Platform.

2. Eligibility

You must be at least 18 years of age to use GymHealth.AI. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Health & Fitness Disclaimer

GymHealth.AI provides AI-generated fitness coaching, nutrition guidance, and wellness information for general informational purposes only. Our content is not a substitute for professional medical advice, diagnosis, or treatment.

• Always consult a qualified healthcare provider before starting any new exercise program or making significant dietary changes.
• Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or other concerning symptoms.
• GymHealth.AI is not liable for any injury, illness, or health outcome resulting from use of the Platform.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information when creating your account.
• Notify us immediately of any unauthorized use of your account.
• Not share your account with or transfer it to any other person.

5. Subscriptions & Billing

GymHealth.AI offers subscription plans including a free trial period, Base Plan, and Pro Plan. By subscribing, you agree to the following:

• Free Trial: New users receive a 10-day free trial. No credit card is required to start a trial via phone verification.
• Billing: Paid subscriptions are billed monthly. Your subscription renews automatically unless cancelled.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial months.
• Price Changes: We reserve the right to change subscription prices with 30 days' notice to existing subscribers.

6. Trainer Marketplace

GymHealth.AI connects users with independent certified personal trainers. Trainers on our platform are independent contractors, not employees of GymHealth.AI. We do not guarantee the quality, safety, or legality of any trainer's services. You engage trainers at your own risk.

GymHealth.AI charges a platform fee on trainer bookings. Payment terms for individual trainer sessions are governed by the booking details presented at checkout.

7. Acceptable Use

You agree not to use the Platform to:

• Violate any applicable laws or regulations.
• Harass, abuse, or harm other users or trainers.
• Upload or transmit malicious code or content.
• Attempt to gain unauthorized access to any part of the Platform.
• Use the Platform for any commercial purpose without our express written consent.
• Circumvent or attempt to circumvent any subscription or payment requirements.

8. Intellectual Property

All content, features, and functionality on GymHealth.AI — including but not limited to text, graphics, logos, AI-generated workout plans, meal plans, and software — are owned by GymHealth.AI and protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any Platform content without our express written permission.

9. User Content

By submitting content to GymHealth.AI (including photos, messages, and fitness data), you grant us a non-exclusive, royalty-free, worldwide license to use, store, and display that content in connection with providing the Platform's services.

You represent that you own or have the right to submit all content you provide, and that it does not violate any third-party rights.

10. Data & Privacy

Your use of GymHealth.AI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We take the security of your personal and health data seriously.

11. Wearable Device Integration

GymHealth.AI may integrate with third-party wearable devices and health platforms (such as Apple Health, Fitbit, Garmin, Whoop, and Oura). Your use of these integrations is subject to the terms and privacy policies of those third parties. GymHealth.AI is not responsible for data provided by or to third-party integrations.

12. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. GYMHEALTH.AI DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GYMHEALTH.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14. Indemnification

You agree to indemnify and hold harmless GymHealth.AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Platform will immediately cease.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Platform after changes become effective constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules.
